DMCA Policy

Dusk Holdings LLC ("Company", "we", "us", or "our"), operator of Lusora ("the Platform"), respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to notices of alleged copyright infringement that are reported to our Designated Copyright Agent.

Filing a DMCA Takedown Notice

To submit a valid DMCA takedown notice, you must provide the following information in writing:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work you claim has been infringed. If multiple works are covered, a representative list is acceptable.
  3. Identification of the material you claim is infringing, with sufficient detail for us to locate it on the Platform (e.g., a URL or description of the content).
  4. Your contact information, including your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

Counter-Notification

If you believe content was removed in error, you may submit a counter-notification to our Designated Copyright Agent containing the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, the District of New Mexico, and that you will accept service of process from the person who submitted the original takedown notice.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days of receiving the counter-notification, we may restore the removed content at our discretion.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, we maintain a policy of terminating accounts of users who are repeat infringers. We reserve the right to terminate any user's access to the Platform at our discretion if we determine that the user has repeatedly infringed the copyrights of others.
